Seven-Figure Settlement for Girl Injured at Birth

Substantial compensation has been secured for a girl who suffered a brain injury as a result of a delay in her delivery.

She required intensive resuscitation after her birth and was not initially expected to survive. She was eventually able to be discharged from hospital, but she was left with a number of disabilities including mild cerebral palsy, developmental delay affecting language and communication, and behavioural issues.

A claim for damages was brought on her behalf against the NHS trust responsible for the hospital where she was born. The NHS trust admitted that the delay in her delivery had been a negligent breach of duty and that it had led to her injuries. However, she also suffers from an unrelated genetic condition and there was a disagreement as to how this would affect her life expectancy.

Medical evidence was obtained from a number of experts to establish the value of her claim and, following negotiations, a settlement was agreed whereby she will receive a lump sum of £4.5 million and significant periodical payments for the rest of her life. The settlement will provide her with the care and support she needs and enable her to purchase equipment and a suitable home.
